Terms and Conditions
Please read the following terms and conditions carefully before renting a houseboat. If you have any questions about the T&Cs, please contact us via email or phone.

1. Booking

A binding booking is made when Wasserkutsche confirms receipt of the 50% deposit of the total charter price. The remaining amount must be paid before departure by bank transfer (payment confirmation), card payment, or cash.

If the booking is made less than 3 weeks before the start of the charter period, the entire charter price is due immediately upon receipt of the invoice without deductions.

If the charterer defaults on the deposit, Wasserkutsche reserves the right to rent the charter object to others and withdraw from the contract.

If the boat trip cannot take place or can only partially take place due to:
- Weather conditions
- Waterway closures
- Flooding
- Damage to the charter object
- Other circumstances outside the charterer’s sphere of influence
the charterer may withdraw from the contract. No claims for compensation will arise in this case. After payment of the rental price and in agreement with the charterer, the charterer can rebook for an alternative date.
2. Security Deposit and Liability

At the beginning of the charter period, the charterer deposits a security deposit of €250. The charterer is entitled to retain from this deposit the costs of damages and losses that are not incurred through ordinary use of the boat (wear and tear), subject to later settlement. The deposit will be refunded upon return of the undamaged boat with all its undamaged equipment.

Upon return of the boat, the charterer shall prepare a list of defects and losses to be handed over to the charterer. Any extraordinary incident (e.g., lines in the propeller, etc.) must be reported upon return of the boat.

The following insurances are included in the charter price:
- Water sports liability insurance
- Water sports hull insurance for property damage on German inland waterways with a deductible of:
- €1,500 (or €250 with liability reduction) for Wasserkutsche, Momme, and Zilius
- €1,500 (or €500 with liability reduction) for the Rossi

Parents are liable for their children and pets.
3. Duties and Rights of the Charterer

The charterer agrees not to leave the specified driving area. The driving area is German inland waterways. License-required areas are excluded, e.g., the Spree in Berlin’s city center (exceptions subject to approval).

The charterer must participate in a detailed handover with instruction and inspection of all technical functions.

Use of the rented items is at your own risk. All users must have adequate swimming abilities or wear sufficient flotation devices.

The charterer agrees to:
- Only take the maximum allowed number of persons on board
- Use the boat only for pleasure trips
- Make no modifications to the ship or equipment
- Seek shelter in a protective harbor during wind forces of 6 or higher
- Not use the boat in fog, flooding, storm, ice, or thunderstorms
- Not sublet or lend the boat
- Not bring pets on board (except with prior booking of the pet surcharge)

Late fees:
- Late pickup: €25 per started hour
- Late return: €25 per started hour
4. Cancellation and Rebooking

In case of cancellation, the following costs apply:
- 30-14 days before charter start: 50% of the charter price
- Less than 14 days before charter start or no-show: 100% of the charter price

If a replacement charter is successful, the charterer will receive their deposit minus a €35 cancellation/rebooking fee.

In case of severe weather with wind forces of 6 or higher, we will retain the deposit and try to find an alternative date.
5. Legal Venue

For all disputes arising from this agreement, if the charterer is an entrepreneur, Berlin is agreed as the place of jurisdiction.

Should individual provisions of this contract be or become ineffective or unenforceable, the validity of the remaining contract remains unaffected.
